Tipperary County council has secured a conviction for waste management offences. Nenagh Circuit court has upheld a conviction ordered at Thurles District Court in 2023. The three charges relate to what the council describe as significant unauthorised waste activities in County Tipperary.
The defendant had previously been convicted at Thurles District Court on 20 June 2023 and although the party did not attend the Thurles hearing an appeal was launched.
The Council’s legal team submitted photographic evidence including details as to the lack of controls to mitigate risk of environmental pollution. The unauthorised waste site created a significant risk to the atmosphere, land, soil and water and has an adverse effect on the countryside according to the council’s legal team. The defendant is the registered land owner of the site in question.
The penalties, imposed by the District Court were upheld by the Circuit Court and total €7,000 for the three offences and in addition Judge Catherine Staines ordered that the defendant discharge costs of €12,300 to Tipperary County Council making the total financial penalty imposed €19,300.
